The website and the web portal are together referred to as Platform. You may be accessing our Site from a computer, tablet or mobile phone device (through website, for example) and these Terms of Use govern Your use of our Site and Your conduct, regardless of the means of access. You may also be using our Services and these Terms of Use also govern Your use of the Services. The Platform is only to be used for Your personal, non-commercial use and information. Your use of the Services and features of the Platform shall be governed by these Terms and Conditions (hereinafter “Terms of Use”) along with the Privacy Policy (together “Policies”) as modified and amended from time to time. This Terms of Use sets forth the legally binding terms and conditions for Your use of the website at www.naawahealth.com, www.naawa.in and www.naawa.health.
By mere accessing or using the Platform, You are acknowledging, without limitation or qualification, to be bound by these Terms of Use and the Polices, whether You have read the same or not.
These policies are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, and are on ‘electronic record’ as contemplated under section 2(t) of the Information Technology Act, 2000 and the Rules thereunder. These Terms being an electronic record are generated by a computer system and do not require any physical digital signatures.
Naawa shall not be held accountable for any losses incurred as a result of any failure of service, mistake, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. There is no intent for our Site to be used in a court of law.
ACCESSING, BROWSING OR OTHERWISE USING OUR SERVICES AND THE PLATFORM INDICATES YOUR UNCONDITIONAL AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS TERMS OF USE, SO PLEASE READ THIS CAREFULLY BEFORE PROCEEDING.

You hereby agree, acknowledge and accept the use of our Site and the services offered including personalized health plans, fitness plans, nutrition plans (“Services”) and other related services through our Site as per the specifications, listed by the Naawa.
2. PRIVACY PRACTICES
We suggest to review our Privacy Policy, which also governs Your visit to www.naawahealth.com, www.naawa.in and www.naawa.health to understand our practices. The personal information / data provided to us by You during the course of visit and usage of our Site will be treated as strictly confidential and in accordance with the Privacy Policies and applicable laws and regulations. As a company, we strive to ensure that Your personal information is sufficiently protected. Apart from these Terms of Use, the Privacy Policy shall also govern Your visit and use of the Site. Your continued use of our Services and the Site implies that You have read and accepted the Privacy Policy and agree to be bound by its terms and conditions.
3. ONLINE SERVICES
3.1. Accessibility of services:
You are responsible for Your devices and accounts. You are responsible for any devices, software and services needed to use the online services. Naawa does not guarantee that the online services will fully function on any particular device or with any particular software. You are also responsible for any messaging and data charges, fees and taxes for Your use of the online services, including when we communicate with You by text, email or other means that You choose. You may only use the online services with devices that You own or control and using only the authorized operating system.

The content of Naawa/our Site/social media, including without limitation, text, audio, video, photographs, illustrations, graphics and other visuals (“Content”), is for informational purposes only. The Content does not constitute/substitute professional medical advice, diagnosis, treatment or recommendations of any kind.
You should always seek the advice of your qualified healthcare professionals with any queries or concerns you may have regarding your individual needs and any medical conditions. You agree that you will not under any circumstances disregard any professional medical advice or delay in seeking such advice in reliance on any content provided on or through the website/ social media. Reliance on any such Content is solely at your own risk.
Results may vary based on each member’s physical health, diet and exercise, an adherence to Naawa’s health programmes. Naawa does not guarantee the results of the programmes.
If you have not been physically active for more than 1 (one) year, or if you have any medical history that may put you at risk, including, without limitation, one or more the following conditions, you are required to seek approval from a qualified health care practitioner prior to using the Services and your results can vary in case of following conditions:
1. Heart disease
2. High blood pressure
3. Family history of high blood pressure or heart disease
4. Chest pain caused by previous exercise
5. Dizziness or loss of consciousness caused by previous exercise
6. Bone or joint problems
7. Diabetes, high cholesterol, obesity
8. Arthritis
9. Smoking/Alcohol Consumption
10. Sedentary lifestyle
11. Lactating (upto 6 months)
12. Kidney disease
13. Irritable Bowel Syndrome
You should discontinue the wellness plan/fitness plans in cases where it causes pain or severe discomfort, and should consult a medical expert prior to returning to exercise in such cases. We reserve the right to deny you access to the Services for any reason or no reason, including if we determine, in our sole discretion, that you have certain medical conditions.
Naawa provides a marketplace to the nutritionist and the customer and Naawa is not responsible for any legal issues between the two parties. Naawa is not responsible for the results or medical consequences.
Naawa provides the pause facility in limited plans and the information and feature is explained or mentioned while selling the plan and not available on all plans/services.
3.3. Refund
At Naawa Health, we are dedicated to the satisfaction and well-being of our clients. Recognizing that circumstances may lead you to reconsider your purchase, we offer a comprehensive refund policy for those looking to cancel their nutrition plan within a specified period.
Naawa will also make a refund in the event that you have paid twice for your health plan or the same is suspended or terminated by Naawa for reasons not attributable to You.
Eligibility for Refunds:
Clients are entitled to request a full refund within 15 days of purchasing any nutrition plan from Naawa Health.
To initiate a refund, clients must email our support team at refunds@naawa.in with specific details regarding their purchase and the reason for the refund.
Information Required for Refund Request:
When requesting a refund, please include the following details in your email to ensure swift processing:
· Name
· Plan Name (Weight Management/Diabetes Management/Hypertension Management)
· Plan Duration
· Plan Start Date
· Bank Account Number
· IFSC Code
· Bank and Branch Name
This information is crucial for processing your refund to the bank account you specify.
Refund Calculation:
A full refund will be issued minus an initial consultation charge, which amounts to 30% of the total plan cost. This deduction is to cover the initial plan creation efforts and other preparatory work by our team.

Refund Calculation Example:
For a 6-month nutrition plan purchased at ₹9,000, the refund calculation if cancelled within the 15-day period would be as follows:
Total cost of the plan : 9,000 - Initial consultation charge (30%): -2,700 = Total refund amount :6,300
Refund Processing:
Refunds will be credited to the original payment method or the bank account details provided in your refund request email within 15 days from the date we receive all required bank account details.
Important: The 15-day refund processing timeline begins only upon receipt of your complete bank account details, not from the initial refund request email. However, your refund request will still be considered valid if the initial email is sent within 15 days of the plan purchase, even if the bank account details are provided later.
You are not eligible for refund after 15 days of making the payment for your plan. In the event that this Terms of Use expires or is terminated, no portion of any payments of any kind whatsoever previously provided hereunder shall be owed or be repayable or refunded to the user.
Naawa Health reserves the right to amend this refund policy at any time without prior notice
3.4. Regarding the cost of the plans:
Naawa sets its own prices for the programmes and has the right to levy any applicable taxes or charges at any time at its sole discretion. It is hereby clarified that certain promotional benefits may not apply to your plan and the final call shall at times vest with Naawa.
3.5. Unsolicited Ideas:
According to our policy, Naawa does not review suggestions that were not specifically requested. Although we value Your interest in Naawa, we are unable to evaluate suggestion submitted from outside our system at this time. You hereby release Naawa and its consultants/employees/associates from any and all claims arising out of their consideration, use or development of any product, design, concept, or other materials similar to, or identical to, Your submission, whether such consideration, use, or development occurs now or in the future.
4. YOUR INFORMATION
Our Services and this Site is directed to be used by adults only. We assume that any minor, if at all, accessing our Site is under the supervision of their guardians. Naawa or its consultants/employees /associates do not knowingly collect information from minors. You acknowledge that the information You provide, in any manner whatsoever, are not confidential or proprietary and does not infringe any rights of a third party in whatsoever nature.
If You are accessing, browsing and using the Site on someone else’s behalf; You represent that You have the authority to bind that person to all the terms and conditions herein. In the event that the person refuses to be bound as the principal to the Terms of Use, You agree to accept liability for any harm caused by any wrongful use of the Site resulting from such access or use of the Site in whatsoever nature.
Naawa will collect personal information from You, which includes Your first and last name, address, mobile number(s), medical history, weight, height or any other information, and You knowingly provide us with this information. This will generally occur when You either:

The information, photo, image, text, software, data, music, sound, graphics, messages, videos or other materials transmitted, uploaded, posted, emailed or otherwise made available to us (“User Content”), are entirely Your responsibility and Naawa will not be held responsible, in any manner whatsoever, in connection to the User Content. You agree to not encourage or assist or engage others as well as Yourself in transmitting, hosting, displaying, uploading, modifying, publishing transmitting, updating or sharing any information that
- is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, trolling, or otherwise unlawful in any manner whatever;
- harm minors in any way;
- infringes any patent, trademark, copyright or other proprietary rights;

Naawa shall in no way be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content. Naawa does not endorse or control the User Content transmitted or posted on the Site by You and therefore, accuracy, integrity or quality of User Content is not guaranteed by Naawa. You understand that by using the Site, You may be exposed to User Content that is offensive, indecent or objectionable to You. Under no circumstances will Naawa be liable in any way for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by You as a result of the use of any User Content transmitted, uploaded, posted, e-mailed or otherwise made available via the Site. 5. SERVICES/SERVICE INFORMATION
Naawa attempts to be as accurate as possible in the description of the Services on our Site. However, Naawa does not warrant that the Services description, information or other content on the Site is accurate, complete, reliable, current or error-free. The Site may contain typographical errors or inaccuracies and may not be complete or current. The services pictures are indicative and may not match the actual Services. Naawa may exercise this right on a case-by-case basis. All descriptions of services or services pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any Services at any time.
Naawa reserves the right to but are not obligated, to limit the sales of our Services or Services to any person, geographic region or jurisdiction, correct, change or update information, errors, inaccuracies or omissions at any time (including after an order has been submitted) without prior notice. Please note that such errors, inaccuracies or omissions may also relate to pricing and availability of the Services.
The user hereby agrees and understands that Naawa is only a website assisting in coordinating the user select the Service. Naawa operates its business transactions through its website in a highly prolific manner.
In case any Services availed is not suitable, please note that Naawa is in no manner responsible for any side-effects. You should carefully read the individual terms and conditions in relation to the Services and consult a specialist before the use of the same.
Additionally, Naawa has complete control over the information transferred to it with respect to the communication feature available on Naawa’s online portal which the users may to use while accessing, browsing the portal. However, any misconduct on the part of the User shall lead to violations of this Terms of Use and stricter actions shall be implemented as per Naawa’s policy.
Without prejudice to the above, Naawa makes no representation or warranty that:
- The Services will meet the user’s requirements; and
- The Services will be uninterrupted, timely, secure or error-free.
6. ACCEPTABLE USES AND RESTRICTIONS FOR THE ONLINE SERVICES
With respect to the online services (which includes content), You may not, and may not allow third parties, to:
- Use the online services for any purpose that is unlawful or prohibited by these terms.
- Delete or change any copyright, trademark, or other proprietary notices.

This does not in any way constitute or imply Naawa endorsement, sponsorship or recommendation of the third party, information, products/services or service or any association and relationship between Naawa and those third parties.
8. LIMITED LICENSE
Subject to Your compliance with these Conditions of Use, Naawa grants You a personal, non-exclusive, non-transferrable and limited licence to access and make non-commercial personal use of this website. However, the same shall not construe any license to download (other than page caching) or modify any content, or any portion thereof, except with express written consent of Naawa. Payment is an integral part of an online ordering experience. All payments shall be collected through secured payment options.
Naawa accepts payment options such as Credit Cards, Debit Cards, Net-Banking, wallets, UPI, etc. as determined by Naawa from time to time.
All payments for purchases made by You on the Sites shall only be in Indian Rupees. In case of a prepaid transaction, after payment for the order has been successfully received by the Naawa, You will be sent a notification by E-Mail on Your registered e-mail address provided to Naawa and/or by SMS/WhatsApp on Your registered mobile number provided to Naawa confirming receipt of Your purchase.
13. GOVERNING LAW AND JURISDICTION
The Terms of Use and the Policies shall be construed in accordance with the applicable laws of India. For proceedings arising therein the Courts at Mumbai shall have exclusive jurisdiction.
14. INDEMNITY
You agree to indemnify and hold harmless Naawa including affiliates, directors, officers, agents, shareholders and partners from and against all actions, proceedings, claims, losses, damages and costs (including attorney fees) and other expenses suffered or incurred due to or attributable to or arising out of (i) violation of any applicable law (ii) breach of any representations, warranties or covenants of the User (iii) breach of the policies, guidelines and conditions of Naawa’s service or Additional Terms or these Terms or Privacy Policy (including any modifications or additional notifications or instructions); (iv) infringement of any third party rights. This Clause survives the termination of these Terms.

All words and expressions used and not defined in this document but defined in the Act or the Rules shall have the meaning respectively assigned to them in the Act or the Rules. Reference to “you” or “your” in this Privacy Policy refers to any natural person (including the consultants/employees of Naawa) who provides to Naawa any Personal Information (PI) or Sensitive Personal Data and Information (SPDI) or any user(s) of Naawa’s Site, whether or not, you avail the Services offered by Naawa.
“Act” shall mean the Information Technology Act, 2000 and Rules thereunder as amended from time to time.

“Personal Information (PI)” shall have the same meaning as under Rule 2 (i) of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time and shall include any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person. Your name, gender, address, phone number, email address, user name, occupation, password, date of birth, billing and credit card information, bank account details, order history, feedback, IP address and location, digital device name, type and configuration, details relating to your download of publications via the service (including details relating to the time of the download, any interruptions, and the success or failure of the downloads), the URL from which you accessed the Site, demographic information or opinions, registration or profile information sent to Us by connected services such as social media handles as may be authorized by you, search contact book if consented by the user and other such detail relating to the above as provided to Naawa; or any of the information received under the above by Naawa for collecting, receiving, possessing, using, processing, recording, storing, transferring, dealing, handling and disclosing under lawful contract or otherwise, collectively referred to as “Personal Information”.
“Rules” shall mean the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time.
“Sensitive Personal Data and Information (SPDI)” shall mean and include information under Rule 3 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time.
“Services” for the purpose of this Privacy Policy shall mean any person who by way of registration has sought or in any manner has requested the services of Naawa.
We take reasonable precautions to secure your Personal information. We have implemented technical, physical, and administrative security measures designed to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your information.

Refunds/Cancellation Policy

At Naawa Health, we are dedicated to the satisfaction and well-being of our clients. Recognizing that circumstances may lead you to reconsider your purchase, we offer a comprehensive refund policy for those looking to cancel their nutrition plan within a specified period.
Naawa will also make a refund in the event that you have paid twice for your health plan or the same is suspended or terminated by Naawa for reasons not attributable to You.
Eligibility for Refunds:
Clients are entitled to request a cancellation/refund within 15 days of purchasing any wellness plan from Naawa Health.
To initiate a refund, clients must email our support team at refunds@naawa.in with specific details as mentioned below regarding their purchase.

When requesting a refund, please include the following details in your email to ensure swift processing:

This information is crucial for processing your refund to the bank account you specify.
Refund Calculation:
A full refund will be issued minus an initial consultation charge, which amounts to 30% of the total plan cost. This deduction is to cover the initial plan creation efforts and other preparatory work by our team.
Refund Calculation Example:
For a 6-month nutrition plan purchased at Rs. 9,000, the refund calculation if cancelled within the 15-day period would be as follows:
Total cost of the plan : Rs. 9,000 - Initial consultation charge (30%): Rs. 2,700 = Total refund amount : Rs. 6,300
Refund Processing:
Refunds will be credited to the original payment method or the bank account details provided in your refund request email within 15 days from the date we receive all required bank account details.
Important: The 15-day refund processing timeline begins only upon receipt of your complete bank account details, not from the initial refund request email. However, your refund request will still be considered valid if the initial email is sent within 15 days of the plan purchase, even if the bank account details are provided later.
You are not eligible for refund after 15 days of making the payment for your plan.
